Documents used along the form

The ICE I-983 form is a critical document for international students participating in Optional Practical Training (OPT) or STEM OPT extensions. However, it is often accompanied by other forms and documents that support the application process and ensure compliance with regulations. Below is a list of additional forms and documents that are commonly used alongside the I-983.

  • Form I-20: This document is issued by the educational institution and certifies a student's eligibility for F-1 status. It outlines the student's program of study and is essential for maintaining legal status in the U.S.
  • Form I-765: This application for employment authorization allows eligible F-1 students to apply for work authorization in the U.S. It must be submitted to USCIS to obtain an Employment Authorization Document (EAD).
  • Form I-94: This form is issued upon entry into the U.S. and serves as proof of a student's immigration status. It indicates the duration of stay and is vital for tracking legal residency.
  • Mobile Home Bill of Sale Form: To facilitate the transfer of ownership, review the comprehensive Mobile Home Bill of Sale form which outlines necessary details for a secure transaction.
  • Employer Offer Letter: A letter from the employer detailing the job offer, including job title, responsibilities, and duration of employment. This document helps establish the relevance of the position to the student's field of study.
  • Job Description: A detailed description of the job duties and responsibilities that the student will undertake during their practical training. This helps demonstrate the connection between the job and the student's academic program.
  • Training Plan: Often part of the I-983, this plan outlines the specific training goals and objectives, ensuring that the student's experience aligns with their educational background.
  • Resume/CV: A current resume or curriculum vitae that highlights the student's educational background, work experience, and skills. This document provides context for the student's qualifications.
  • Proof of Employment: Documentation such as pay stubs or employment verification letters that confirm the student's employment status during their training period.
  • Compliance Documentation: Any additional documents that prove compliance with program requirements, such as evaluations or reports related to the training experience.

Each of these documents plays a significant role in supporting the I-983 form and ensuring that the student's application for practical training is complete and compliant with U.S. immigration regulations. Proper preparation and submission of these forms can facilitate a smoother process and enhance the student's experience in the United States.

Misconceptions

The ICE I-983 form, also known as the "Training Plan for STEM OPT Students," is often misunderstood. Here are ten common misconceptions about this form, along with clarifications to help you understand its purpose and requirements.

  1. Misconception: The I-983 form is optional.

The I-983 form is not optional for students applying for the STEM OPT extension. It is a required document that outlines your training plan and must be submitted with your application.

  2. Misconception: Only the student needs to fill out the I-983 form.

Both the student and the employer must collaborate on the I-983 form. The employer plays a crucial role in providing information about the training and ensuring it meets the necessary criteria.

  3. Misconception: The I-983 form is a one-time submission.

The I-983 form must be updated and resubmitted if there are any significant changes in your training plan or employment situation during your STEM OPT period.

  4. Misconception: The I-983 form guarantees STEM OPT approval.

Completing the I-983 form does not guarantee that your STEM OPT application will be approved. It must be filled out accurately and meet all USCIS requirements.

  5. Misconception: The I-983 form can be filled out quickly.

Filling out the I-983 form requires careful thought and consideration. It is essential to provide detailed and accurate information about your training plan.

  6. Misconception: Employers do not need to sign the I-983 form.

Employer signatures are mandatory on the I-983 form. This confirms their commitment to providing the training outlined in the plan.

  7. Misconception: The I-983 form is only for specific fields of study.

The I-983 form is applicable to all STEM fields recognized by USCIS. It is not limited to certain disciplines, as long as the degree qualifies under the STEM OPT extension.

  8. Misconception: There is no need to include a detailed training plan.

A detailed training plan is essential. The I-983 form should clearly outline the goals, objectives, and methods of training to demonstrate its relevance to your degree.

  9. Misconception: The I-983 form is only reviewed by USCIS.

While USCIS reviews the I-983 form, it may also be subject to review by your Designated School Official (DSO) and other regulatory bodies, ensuring compliance with the training requirements.

  10. Misconception: You can submit the I-983 form after applying for STEM OPT.

The I-983 form must be submitted at the same time as your STEM OPT application. Delaying its submission could lead to complications or delays in processing your application.

Understanding these misconceptions can help ensure that you complete the I-983 form correctly and meet all necessary requirements for your STEM OPT application.

Understanding ICE I-983

  1. What is the ICE I-983 form?

The ICE I-983 form, formally known as the "Training Plan for STEM OPT Students," is a document required by the U.S. government for students on F-1 visas who are applying for the STEM Optional Practical Training (OPT) extension. This form outlines the training and work experience the student will receive during their employment in a STEM field. It must be completed in collaboration with the employer and submitted to the Student and Exchange Visitor Program (SEVP) for approval.

  2. Who needs to complete the I-983 form?

Any F-1 student who is eligible for the STEM OPT extension must complete the I-983 form. This includes students who have earned a degree in a designated STEM field and are currently on post-completion OPT. The form must be filled out in conjunction with the employer, who will provide details about the training program, including the goals and objectives.

  3. What information is required on the I-983 form?

The I-983 form requires several key pieces of information, including:

    • The student's personal information and educational background.
    • Details about the employer, including the company name, address, and the name of the supervisor.
    • A description of the training program, including the goals, objectives, and how the training relates to the student's field of study.
    • Information on how the employer will provide oversight and evaluation of the student’s progress.
    • Plans for reporting any changes in the training program or the student's employment status.
  4. How is the I-983 form submitted?

The I-983 form is not submitted directly to USCIS. Instead, the student must keep the completed form in their records and submit it to their Designated School Official (DSO) for review. The DSO will then update the student's SEVIS record to reflect the training plan. It is essential to maintain this documentation in case of future audits or inquiries.

  5. What happens if there are changes to the training plan?

If there are any changes to the training plan, the student and employer must update the I-983 form accordingly. Significant changes may include alterations in job responsibilities, the employer's information, or changes in the training goals. The updated form must be submitted to the DSO, who will then update the SEVIS record. It is crucial to report these changes promptly to ensure compliance with STEM OPT regulations.
